1. Agreement to terms
These Terms of Service ("Terms") are a binding agreement between you and FamilyMedApp LLC, a Texas limited liability company ("FamilyMedApp," "we," "us"). They govern your access to and use of the FamilyMedApp website, progressive-web application, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and able to form a binding contract under the laws of your jurisdiction. You may record information about minor children in your legal care, but minors may not create their own accounts. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Your account
- You are responsible for keeping your login credentials, two-factor codes, and any PIN you set confidential.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at help@familymedapp.com if you suspect unauthorized access.
- One account per person. You may not share, sell, or transfer your account without our written consent.
4. Subscriptions, trials, and billing
4.1 Free trial
New users receive a 14-day free trial of paid features. You may cancel at any time before the trial ends to avoid being charged. If you do not cancel, your subscription will automatically begin at the end of the trial at the then-current price.
4.2 Subscription and renewal
Subscriptions renew automatically at the end of each billing cycle (monthly or annual, as selected) until cancelled. You authorize us, through our payment processor, to charge your payment method on each renewal date. Prices are shown in the app and may change with reasonable advance notice.
4.3 Payment processor
All payments are processed by Stripe, Inc. Your payment information is governed by Stripe's terms and privacy policy. We do not store full card numbers on our servers.
4.4 Cancellation
You can cancel your subscription at any time from your account's billing portal. Cancellation takes effect at the end of the current billing period; you retain access until then.
4.5 Refunds
Except where required by law, payments are non-refundable. We may, in our sole discretion, offer a refund or credit on a case-by-case basis.
4.6 Failed payments
If a renewal payment fails, we will attempt to charge your payment method again and will notify you by email. If payment is not resolved within a grace period, your access may be limited or suspended.
5. Your content and licence to us
You retain all rights in the health records, family member information, notes, and other content you enter ("Your Content"). You grant us a limited, non-exclusive, royalty-free licence to host, store, encrypt, display back to you, and process Your Content solely to provide and improve the Service for you. This licence ends when you delete Your Content or your account, except for backups that are overwritten in the ordinary course and information we are required to retain by law.
You represent and warrant that you have the right to provide Your Content to the Service and that doing so does not violate any law or the rights of any third party.
6. Acceptable use
You agree not to:
- Use the Service to violate any law or regulation.
- Upload content that infringes intellectual-property rights, is defamatory, harassing, or sexually exploitative of minors.
- Attempt to gain unauthorized access to the Service, other accounts, or underlying infrastructure.
- Probe, scan, or test the vulnerability of any system without our written authorization.
- Introduce malware or interfere with the integrity, security, or performance of the Service.
- Reverse-engineer, decompile, or extract the source code of the Service, except where such restriction is prohibited by law.
- Use automated means to scrape, crawl, or harvest data from the Service.
- Resell, sublicense, or commercially redistribute the Service without our written consent.
- Use the Service to store information about individuals who have not consented to their information being recorded by you.
7. Medical disclaimer and no medical advice
FamilyMedApp is a software tool that helps you organize and retain medical information for yourself and your family. The Service is not a medical device, electronic health record system, or a substitute for professional medical care. Content in the Service is not medical advice and must not be used to diagnose, treat, cure, or prevent any disease or condition. Always seek the guidance of a qualified healthcare professional for medical questions and never disregard or delay professional medical advice because of something you read or tracked in the Service. 8. Third-party services
The Service may integrate with third-party services (for example, calendar subscription feeds you add to Google, Apple, or Outlook calendars; payment processing by Stripe; email delivery by Brevo). Your use of those services is governed by the third party's terms, and we are not responsible for their practices.
9. Intellectual property
All rights, title, and interest in the Service (excluding Your Content) — including software, design, branding, text, graphics, and logos — belong to FamilyMedApp LLC or its licensors and are protected by intellectual-property laws. We grant you a personal, limited, non-transferable, revocable licence to use the Service in accordance with these Terms. No other rights are granted.
10. Service availability and changes
We strive to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue any part of the Service at any time. We will give reasonable notice of material changes that negatively affect paid subscribers.
11. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk for us or other users, or if we are required to do so by law. You may terminate your account at any time by deleting it from Settings or by contacting help@familymedapp.com. Upon termination, your right to use the Service ends immediately.
12. Disclaimers of warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT YOUR DATA WILL ALWAYS BE SECURE OR AVAILABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES; IN THOSE CASES, THE EXCLUSIONS ABOVE MAY NOT APPLY TO YOU.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FAMILYMEDAPP LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, THE LIMITATIONS ABOVE APPLY TO THE MAXIMUM EXTENT PERMITTED.
14. Indemnification
You agree to defend, indemnify, and hold harmless FamilyMedApp LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.
15. Governing law and dispute resolution
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts, unless otherwise required by applicable law of your place of residence.
Before filing a claim, you agree to contact us at help@familymedapp.com and try to resolve the matter informally for at least 60 days.
16. Changes to these Terms
We may revise these Terms from time to time. If the changes are material, we will notify you by email and/or by a prominent in-app notice before they take effect. Continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. The "Last updated" date above shows when this page was most recently revised.
17. Miscellaneous
- Entire agreement. These Terms, the Privacy Policy, the Cookie Policy, and the Medical Disclaimer form the entire agreement between you and us regarding the Service.
- Severability. If any provision is held invalid, the remaining provisions will continue in effect.
- No waiver. Our failure to enforce any right is not a waiver of that right.
- Assignment. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Notices. We may send notices by email to the address associated with your account or by posting in the app.
